THIS SECTION AIMS TO EXPLAIN THE PROCESSING OF PERSONAL DATA IMPLEMENTED IN THE CONTEXT OF THE USE OF OUR SERVICES

THE MOBILBOARD COMPANY, AS RESPONSIBLE OF TREATMENT,UNDERTAKES TO RESPECT THE PROVISIONS OF THE LAW N°78-17 OF JANUARY 6, 1978 MODIFIED RELATING TO DATA PROCESSING, THE FILES AND FREEDOMS AS REGARDS THE AUTOMATED TREATMENT OF PERSONAL DATA CARRIED OUT AS WELL AS THE REGULATION (EU) N°2016/679 OF APRIL 27, 2016 AS FROM ITS APPLICATION ON MAY 25, 2018.

IN THE FORMS FOR COLLECTING PERSONAL DATA ON THE WEBSITE AND FROM THE APP IN THE AGENCY, THE USER IS INFORMED IN PARTICULAR: OF THE IDENTITY OF THE DATA CONTROLLER, OF HIS OR HER RIGHTS REGARDING PERSONAL DATA, OF THE RECIPIENTS, OF THE PURPOSE OF THE PROCESSING AND OF THE COMPULSORY OR OPTIONAL NATURE OF HIS OR HER ANSWERS.

WHO COLLECTS PERSONAL DATA ?

The person in charge of the treatment implemented on the mobilboard.com site and the mobile applications is: MLC Management, Simplified Joint Stock Company with a capital of 5.000 Euros, registered in the Trade and Companies Register of Nice under the number 799 201 223 whose head office is located at 18 avenue Jean Médecin in Nice (06000).


WHAT ARE THE PURPOSES OF COLLECTING YOUR PERSONAL DATA?

MOBILBOARD collects and records personal data from its Users for the following purposes

- Management of the shopping cart and reservations

- Management of customer service

- Provision of sharing tools on social networks

- Sending targeted commercial offers by email, on social networks or any other medium.

- Collection of customer reviews on the services marketed

- Display of targeted advertisements on the site and on social networks

- Management of a training register for the driving of the proposed means of transport

- Fight against fraud during the payment of the order

With the exception of commercial prospecting operations, MOBILBOARD considers that all of the above processing operations are necessary for the execution of the contract between a Client and the licensed MOBILBOARD agency. Commercial prospecting operations are based on the consent of the person concerned to the processing of his/her data.

TO WHOM IS YOUR DATA TRANSMITTED?

Data is transmitted to MOBILBOARD's partners who may process the data on their behalf (these are recipients) or solely on behalf of and in accordance with MOBILBOARD's instructions (these are subcontractors). The recipients of the data are:

- Local agencies under license of the Mobilboard brand

- The police authorities within the framework of the legal requisitions concerning the fight against the fraud

- The commercial partners and in particular marketing and advertising agencies

MOBILBOARD also uses subcontractors for the following operations:

- Secure payment on the site

- The fight against fraud

- Carrying out maintenance operations and technical developments of the website

- The collection of customer reviews

WHAT ARE MY RIGHTS AND HOW TO EXERCISE THEM WITH MOBILBOARD ?

Any natural person using the service has the right to exercise their rights of access, rectification, opposition and deletion of their data in accordance with Articles 38 to 40 of the Act of 6 January 1978. IS MY DATA SENT OUTSIDE THE EU ?

HOW LONG WILL MY DATA BE KEPT?

MOBILBOARD has established specific rules regarding the length of time it retains Users' Personal Information. In order to calculate the most appropriate retention period, MOBILBOARD distinguishes between prospects who have never made a purchase from MOBILBOARD and its licensed agencies, and customers who have already made a reservation or service. A separate retention period will be applied to prospects and customers. For prospects, the starting point of the retention period is the last prospecting mailing in which the prospect is likely to be interested. For customers, the starting point of the retention period is the last reservation or the last service provided by the customer to MOBILBOARD or one of its licensed agencies. The length of time a customer's data is retained will vary depending on whether or not the customer is a member of a loyalty program. WHAT SECURITY MEASURES ARE TAKEN TO PROTECT MY DATA?

General rules:

As the company responsible for processing, MLC Management takes all necessary precautions to preserve the security and confidentiality of data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties. In accordance with article 35 of the law 78-17 of January 6, 1978, the subcontractors undertake to respect the security and confidentiality of the data.

Rules applicable to bank and credit card data:

In order to ensure the security of payments, MOBILBOARD uses the services of the service provider Elloha, which relies on the services of the company Stripe, certified PCI-DSS. This norm is an international security standard whose objectives are to ensure the confidentiality and integrity of cardholder data, and thus to secure the protection of card and transaction data. When you make a reservation by payment or credit card guarantee at one of the licensed MOBILBOARD agencies, the Elloha reservation system connects in real time with the Stripe system, which collects your data and carries out various checks to prevent abuse and fraud. The data is stored on the Stripe servers and is not transmitted to MOBILBOARD's servers at any time.

WHAT SHOULD YOU KNOW ABOUT THE DATA COLLECTED BY SOCIAL NETWORKS?

MOBILBOARD offers to use social networks to enhance our business relationship and to provide you with targeted advertising offers on those networks. Using social networks to interact with MOBILBOARD may result in the exchange of data between MOBILBOARD and those social networks. For example, if you are connected to the Facebook social network on your computer and you visit a page on the MOBILBOARD site, Facebook may collect this information. MOBILBOARD encourages you to review the privacy policies of the various social networks to see what personal information they may collect. Principles applicable to Mobilboard:

MOBILBOARD uses your personal information to send you targeted advertising, particularly by e-mail or SMS. In this context, MOBILBOARD undertakes to respect the rules applicable to each prospecting channel.

Prospecting by email and SMS:

MOBILBOARD complies with the rules laid down in Article L34-5 of the French Postal and Electronic Communications Code, which requires the User's express prior consent to be obtained for the sending of commercial prospecting by electronic means (e-mail or SMS). Thus, when validating your departure form on a digital tablet, you are expressly asked for your consent to receive offers from MOBILBOARD. There is an exception in the event that the User, without having given his or her prior consent, may nevertheless be canvassed if he or she is already a client of MOBILBOARD and the purpose of the canvassing is to offer similar products or services.
